By accessing and using the MomentThings platform, including our website builder, templates, and hosting services (collectively, the 'Service'), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this Service.

MomentThings provides an online platform that allows users to create, design, and host event websites ('User Sites'). You understand and agree that the Service is provided 'AS-IS' and that MomentThings assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

You are responsible for all activity that occurs under your account. You agree to: (a) Provide true, accurate, current and complete information about yourself; (b) Maintain the confidentiality of your password and account; (c) Not use the Service for any illegal or unauthorized purpose; (d) Ensure that your content does not violate any copyright, trademark, or other proprietary rights.

The Service and its original content, features, and functionality (including but not limited to all templates, designs, software, code, and graphics) are and will remain the exclusive property of MomentThings. User Content (photos, text, videos provided by you) remains your property, but you grant us a license to host and display it for the purpose of providing the Service.

Services are billed on a one-time basis per event website. Prices are as listed on our Pricing page. Refunds are governed by our Refund Policy, which essentially allows for refunds before development work begins or in cases of service failure.

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

In no event shall MomentThings, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

By using MomentThings to create invitations and manage special moments, you acknowledge and agree that we may process and utilize your aggregated, de-identified event metadata, design patterns, and platform activity data to construct, optimize, and serve targeted advertisement campaigns and custom promotional channels. We strictly safeguard all personally identifiable user profiles in accordance with our Privacy Policy.
